charges if unsubscribing

We have just started using this service. In the agreement, there was a section that mentioned if cancelling the service you "may be charged" as if subscribed under a 24 month agreement. The previous section stated that the service is month to month. We did not agree to a 24 month service. Which is correct?

Depending on where and how you ordered, you may, or may not be under a 24 month contract with an early termination fee. 

Depending on where and how you ordered, you may have a purchase agreement where you are paying for one or more DIRECTVstream set-top boxes at $5/month, and you would be charged the unpaid remainder of the $120 total for each box if you terminate prior to the purchase agreement ending at month 24.  If this is the case (unless you got more than one box), then you are not under a 24 month contract for the service, you just have to finish paying for the boxes.  You cannot return the boxes for credit, or in lieu of paying the balance.

You should have signed an agreement if you are under contract.  A contract normally comes with a "free" set top.
